MGL Chapter 142A Section 5 establishes the Residential Contractor's Guaranty Fund to compensate owners for actual losses caused by a registered contractor's work found by a court or arbitrator to have been performed in a poor or unworkmanlike manner, where the contractor has failed to pay the judgment or award. Two limits are written into the chapter: Section 1 confines it to a pre-existing owner occupied building of one to four dwelling units, so an owner of a rented two or three family house cannot claim on it, and Section 2 excludes from the Fund any homeowner who secures their own permits.
